The Legal Unit is responsible for providing legal service for the Ministry and its departments under it. Legal services covering legal advice, drafting of the law, handling cases of prosecution as well as represent the Ministries and departments under it in any action suit in court.
Background
Objective
- To provide quality and professional legal service in accordance with the Federal Constitution and the laws of Malaysia to the Ministry and its departments.
Roles And Responsibilities
a) Advisory
- Providing legal advice and opinion in respect of legal issues referred to by the Ministry and its departments
- Preparing and vetting any legal documents such as agreements, contracts, memorandum of understanding etc
- Answerable and responsible to the International Affairs Division of the Attorney General’s Chambers regarding international matters and issues
- Responsible to the International Affairs Division, Department of the Attorney for matters involving the case of international
b) Drafting
- Drafting any laws (new / amendment) either in the form of principal legislation or subsidiary legislation
- Drafting any other legal instruments such as gazette of appointment, delegation of powers by the Minister etc
- Answerable and responsible to the Drafting Division of the Attorney General’s Chambers
c) Prosecution
- Conducting or assisting certain prosecution cases generally under the purview of the Ministry and specifically under the enforcement departments such as the Atomic Energy Licensing Board (AELB)
- Monitoring any prosecution cases conducted by the prosecuting officers in the Ministry’s enforcement departments
- Authorising the prosecuting officers to prosecute cases
- Answerable and responsible to the Prosecution Division of the Attorney General’s Chambers
d) Legal
- Representing the Government of Malaysia in any civil proceedings involving the Ministry and its departments
- Preparing the necessary pleadings in any civil proceedings
- Answerable and responsible to the Civil Division of the Attorney General’s Chambers
